The Etiket Gift Card Holiday 2022 Giveaway

The Etiket Gift Card giveaway is organized by Etiket and takes place in Canada. The giveaway will take place between December 19th and  December 23, 2022. The Winners will be notified directly by Direct Message on Instagram. 

1-ELIGIBILITY

This giveaway is open to all Canadian citizens aged eighteen (18) and over at the time of the giveaway. The following people will not be eligible: employees of Etiket, as well as the employees of any company or organization that collaborates in this giveaway, representatives or agents, publicity and promotion agents, as well as the members of their immediate family (father, mother, brothers, sisters, children), their legal or common-law spouse and any person with whom they are living.

 

2-METHOD OF ENTRY

2.1 In order to enter, the entrant must follow the rules on the Etiket Boutique Instagram post related to this contest. Etiket’s social media team will draw a winner at the close of the giveaway each day. 

2.2 This promotion and giveaway is in no way sponsored, endorsed or administered by, or associated with, Instagram or Facebook.

2.3 By participating in this promotion and entering this giveaway, each entrant and/or attempted entrant agrees to release, indemnify, and forever hold harmless the Partners and their directors, managers, employees, shareholders, agents, or other representatives (together, the “Indemnified Parties”) of all claims, actions, damages, means of action, causes of action, lawsuits, debts, duties, accounts, bonds, agreements, guarantees, indemnities, contracts, or liabilities of any kind whatsoever resulting from or related to entry or attempted entry in this giveaway, compliance or failure to comply with these giveaway rules, or the acceptance or use of the prize.

 

3-NO PURCHASE NECESSARY.

Although online access, an email account is required to participate in the giveaway, no purchase is necessary to enter. A number of public libraries, retail businesses and other establishments offer public use of computers connected to the Internet for free, and certain Internet service providers or other companies offer free email accounts. 

4-LIMIT OF ENTRIES

4.1 If the identity of an entrant is challenged, the holder of the email address account or Instagram account used at the time of entry will be determined as being the entrant. The person to whom an email address or Instagram account was assigned by an Internet service provider, online service provider, or any other organization responsible for assigning email addresses for the domains associated with the email address submitted or Instagram identity submitted is considered the holder of the authorized account. In the context of this giveaway, when employed in these rules and regulations, the term “Entry” collectively refers to the original entry and the entries by reference.

4.2 Only electronic entries received by 11:59 p.m. (EST) each day until December 23, 2022 will be considered eligible.

5-ODDS OF WINNING

The odds of an entry being selected depend on the number of entrants submitted.

6-THE PRIZE(S)

6.1 The retail value of the Etiket Gift Card prize is $50 CAD. The prize must be accepted as is and may not be exchanged, transferred or redeemed for cash.

6.2 Any other costs incurred by the winner are excluded and remain the exclusive responsibility of the winner.

6.3 The winners win: THE PRIZE described above.

6.4 There will be 1 winner during the giveaway period each day.

6.5 A representative of the giveaway organizer will be in touch with the winner via direct message in the 24 hours following the draw in order to inform him or her of the conditions for awarding the prize. In the event that the giveaway organizer’s representative is unable to reach the winner in the week following the draw, the giveaway organizer will be released of any obligation towards the person in question, in which case Etiket reserves the right at its sole and absolute discretion to select at random another entrant as the potential prize winner. Proof of legal entry age may be required.

6.6 The identities of the winners may be displayed on the following sites and web addresses:

3. c) any other social media support/platform judged pertinent by Etiket.

7-CLAIMING PRIZE

7.1 The prize must be accepted as described in these rules and regulations, and may not be transferred to another person, substituted for another prize or exchanged in part or in full. Despite the above, in the event that, for reasons not related to the winner, the giveaway organizer cannot award the prize, or apart thereof, as described in these rules and regulations, they reserve the right to award a prize that they deem equivalent.

7.2 The refusal by a person selected as a winner to accept the prize, or a part thereof, according to the conditions set forth in these rules and regulations releases the giveaway organizer of any obligation relating to this prize or this portion of the prize towards this person.

7.3 In order to obtain the prize, the selected entrant must first, in addition to meeting the giveaway eligibility criteria and complying with the official giveaway rules and regulations (the “Winner”):

1. a) reply to the email sent by the giveaway Partner or its representatives in the 48 hours following the selection of his or her entry.

7.4 Delivery of prize

The selected entrant must follow and respect the instructions and procedures communicated by the Partner and its representatives in order to receive his or her prize.

7.5 Disqualification

If any of the conditions stipulated above are not met, the selected entrant will be disqualified and shall not be entitled to receive any prize, in which case the Etiket crèmes de luxe reserves the right, at its sole and absolute discretion, to select at random another eligible entrant as the potential prize winner.

8-GENERAL CONDITIONS

8.1 The Winner must release the giveaway organizer and the giveaway partners, as well as any person designated by them, of any responsibility with regard to any damages that maybe suffered as a consequence of accepting this prize, or the organizing or holding of the activity described in the giveaway. The failure or refusal of the Winner to give effect to this section will release the giveaway organizer of any obligation to award this Winner any prize whatsoever.

8.2 By entering this giveaway, all entrants consent to having his or her name and used for compensation.

8.3 The odds of being declared a winner, for giveaway entrants, will depend on the number of valid entries received at the time of the draw. 

8.4 The giveaway organizer reserves the right to eliminate, at its discretion, entry forms sent by group (spamming) and those of doubtful origin.

8.5 The giveaway organizer reserves the right to disqualify any person or cancel thee ntry of any person entering this giveaway or attempting to enter this giveaway by means that are contrary to these rules and regulations. According to the nature of the act, this person may be referred to the legal authorities, as the case may be.

8.6 All entry forms become the property of the giveaway organizer and no communication will be exchanged with the entrants as part of this giveaway other than in compliance with these rules and regulations or on the initiative of the giveaway organizer.

8.7 For the purposes of this giveaway, the entrant is the person whose contact details appear on the electronic form sent to the giveaway organizer.

8.8 The giveaway organizer, the giveaway partners, their subsidiaries, their employees, agents and representatives, are not liable for the incorrect operation of any IT component, software, or line of communication used to transmit the electronic form, or any transmission that is defective, incomplete, incomprehensible or erased by any system, computer or network and that may limit the possibility of or prevent any person from entering this giveaway.

8.9 The giveaway organizer, the giveaway partners, their subsidiaries, their employees, agents and representatives are also not liable for any damages or loss that may be caused, directly or indirectly, in full or in part, by the downloading of any Internet page, software or form, or by the transmission of any information regarding participating in this giveaway.

8.10 The giveaway organizer reserves the right, at its sole discretion, to cancel, end, modify or suspend this giveaway in full or in part in the event that an event, error or human intervention of any sort occurs that may corrupt or affect the administration, security, impartiality or conduct of the giveaway asset forth in these rules and regulations, subject to approval by the Régie des alcools, des courses et des jeux du Québec, if required.

8.11 The giveaway organizer does not in any way guarantee that these websites and/or servers, as well as those of its giveaway partners, suppliers and/or other websites used for the purpose of this giveaway, will be accessible or functional without interruption throughout the entire giveaway period or

that they will be free of error. In the event the entry forms cannot be sent, for any reason

whatsoever, the giveaway organizer, the giveaway partners, their subsidiaries, and their  employees, agents and representatives cannot be held responsible.

8.12 By entering this giveaway or attempting to enter it, each entrant and/or attempted entrant agrees to release, indemnify, and forever hold harmless thePartners and their directors, managers, employees, shareholders, agents, or other representatives (together, the “Indemnified Parties”) of all claims, actions, damages, means of action, causes of action, lawsuits, debts, duties, accounts, bonds, agreements, guarantees, indemnities, contracts, or liabilities of any kind whatsoever resulting from or related to entry or attempted entry in this giveaway, compliance or failure to comply with these giveaway rules, or the acceptance or use of the prize. The Indemnified

Parties will not be held responsible for lost, incomplete, late, or misdirected entries, or for any problem with the Facebook platform during the giveaway period, or for any technical malfunction or other problem with the telephone lines or networks, the online IT systems, the servers, the Internet access providers, the equipment or software or any other technical problem or problem with Internet traffic or the website, or any combination of the above, and will not be held responsible for any injury or damage to any person or property resulting from or related to entry or attempted entry by this person or any other person in this giveaway. Any attempt to deliberately damage any website or to undermine the legitimate operation of this giveaway is a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

8.14 If a section of these rules and regulations is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.

8.15 For Quebec residents, any disputes respecting the conduct or organization of a publicity giveaway may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
